By accessing or using Uptake Anesthesia ("the Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Disclaimer & Terms of Use. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Uptake Anesthesia is an educational research tool that retrieves published medical literature, clinical trial data, and drug labeling information, and uses artificial intelligence to synthesize evidence-based responses for anesthesia providers. The Service is intended solely for educational and informational purposes and does not provide medical advice, diagnosis, or treatment recommendations.

3. Eligibility

The Service is intended for use by licensed or student healthcare professionals with clinical training in anesthesia, including Certified Registered Nurse Anesthetists (CRNAs), student registered nurse anesthetists (SRNAs), anesthesiologists, and other anesthesia providers. You must be at least 18 years old to create an account. Non-clinical users may access the Service but should not act on any information without consulting a qualified healthcare provider.

4. User Accounts

To access certain features, you may create an account using an email address and password or through a supported single sign-on provider (e.g., Google). You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate profile information (name, specialty, institution)
• Notifying us promptly of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for abusive, fraudulent, or unauthorized purposes.

5. Acceptable Use

You agree not to:

• Use the Service for direct patient care decisions without independent clinical verification
• Enter Protected Health Information (PHI) or patient-identifying data into the Service
• Attempt to circumvent rate limits, access controls, or authentication mechanisms
• Scrape, crawl, or programmatically access the Service without written permission
• Reverse-engineer, decompile, or attempt to extract the source code of proprietary components
• Use the Service to generate content that is misleading, harmful, or defamatory
• Resell, redistribute, or commercially exploit the Service or its outputs without permission
• Interfere with the Service's infrastructure, security, or availability

6. Intellectual Property

The Service's software, design, branding, and curated content are the property of Uptake Anesthesia and are protected by applicable intellectual property laws. Third-party content retrieved by the Service (PubMed abstracts, FDA labeling, clinical trial data, StatPearls chapters) is subject to the terms and licenses of their respective publishers and data providers. You may use AI-generated responses for personal educational and research purposes but may not republish them at scale without attribution.

7. Donations & Payments

The Service is provided free of charge. Voluntary monthly donations may be made to support operational costs. Donations are processed by Stripe, Inc. and are subject to Stripe's Terms of Service. Donations do not grant additional features, priority access, or service-level guarantees. Recurring donations may be cancelled at any time through the Stripe customer portal accessible from your account settings.

8. Availability & Modifications

We strive to maintain the Service's availability but do not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Update these Terms with reasonable notice (continued use constitutes acceptance)
• Adjust rate limits, feature availability, or supported data sources
• Perform maintenance that may temporarily affect availability

9. Disclaimers & Limitation of Liability

10. Termination

You may stop using the Service at any time. We may terminate or suspend your account if you violate these Terms. Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from the use of the Service shall be resolved in the courts of competent jurisdiction.
